Yesterday, Contact Center Compliance conducted our first Telephone Consumer Protection Act (TCPA) webinar of the year, hosted by CCC’s Director of Compliance Services, Arvell Craig. As usual, our guest was Eric Troutman, the Czar of TCPAWorld. For our regular webinar attendees, his presentation served as an informative update to the wide range of important TCPA-related topics that he has discussed in the past. For those less familiar with his appearances on our webinars, it was a thorough explanation of the current state of TCPA litigation.

Topics covered included:

  • An explanation of why the TCPA is such a troublesome source of litigation
  • Critical takeaways on the TCPA post-Facebook, risks to online lead generators, the safest dialing methods, wrong number risks, and personal liability
  • Eric’s Ten Commandments of Federal Telecom Law
  • Facebook’s complicated impact on autodialer litigation
  • Comparing the risks between click-to-dial, predictive dialers, and human selection systems
  • Consent requirements, the ESIGN Act, and lead generation
  • The trend of multiple violations per-call compounding the per-call penalties
  • The implications of a notable, potentially record-setting TCPA settlement that is incoming
  • The effects of new Federal Communications Commission (FCC) Chair Jessica Rosenworcel’s robocall blocking priorities on call deliverability
  • How the process of using the reassigned number database (RND) works from a practical standpoint

Eric discussed all these topics and more with his usual combination of flair and expertise, bringing in relevant case studies to illustrate his points and going through the specific legal reasoning with a fine toothed comb. He also addressed some frequently asked questions and included some extremely detailed and useful graphics—including updated versions of previous graphics—among his slides. In fact, the conversation was so detailed that we weren’t able to get through every slide. As a result, there is even more valuable information in the slides than what we covered in the webinar itself. To watch the recording of the webinar and download the slide deck, click here. And keep an eye out for upcoming CCC webinars!
