The U.S. District Court for the Central District of Illinois issued a major order granting partial summary judgment on December 12, 2014 against Dish Network. In the order the Court found that Dish Network was liable for millions of calls in violation of the TSR.
An approximate breakdown of the illegal calls Dish was held liable for include:
- 4.1 million calls made by Dish or its vendors to numbers on the DNC
- 2.7 million calls made by Dish’s retailers to numbers on the DNC
- 1 million calls made to consumers on Dish’s internal DNC list
- 49.7 million abandoned calls made by Dish or its retailers
The Court also issued several findings in favor of the four state co-plaintiffs, such as finding that Dish had made outbound calls to residents of the states whose numbers were on the DNC. This case is another example of a major company being held liable for the actions of its third part vendors and retailers.
