New York Governor Kathy Hochul issued an executive order extending a number of existing disaster emergencies through October 23. These disaster emergencies date back to former Governor Andrew Cuomo’s tenure, which ended abruptly when he left office in late August. Thanks to 2019’s Nuisance Call Act, these disaster emergencies trigger restrictions on telemarketing calls into the affected counties.
One of the disaster emergencies is a statewide emergency relating to gun violence, meaning no telemarketing calls may be placed into the state until October 23. These disaster emergency extensions are unrelated to the Tropical Depression Ida disaster emergency that Governor Hochul had declared and then extended through October 17.
This whole situation is very confusing so let us emphasize the most important point: it is a violation of the Nuisance Call Act to make telemarketing calls into New York until October 23.
As always, we will continue to monitor this situation and publish any updates when they become available
